The State Bar Court of California has issued a public reproval to former Sutter County Judge Timothy J. Evans, who has been convicted twice of drunken driving.
Conditions of the reproval, which will take effect Thursday, include abstaining from alcohol and providing urine or blood tests within six hours of being contacted by the court’s probation unit.
Evans, who has a private law practice in Marysville, was not immediately available for comment.
Evans was arrested for driving under the influence on Nov. 6, 2006, and again on July 14, 2008. Each time his blood alcohol content was 0.22 or more, or about three times the legal limit.
The reproval does not include a suspension or revocation of Evans’ license to practice law. Mitigating circumstances in his favor include no prior discipline as well as cooperation with victims, the court said.
Evans hit another vehicle with his car in the parking lot of the Red Robin restaurant in Yuba City. No one was injured.
Evans showed remorse for his actions, the court said.
Also cited was Evans’ “good character” as demonstrated by “a wide range of references in the legal and general communities who are aware of the full extent of his misconduct,” according to a court document.
The court ordered Evans to attend substance abuse meetings and noted that he is already doing so at least once a week at Pathways, a Yuba City facility.
He was also ordered to attend a session of the State Bar Association’s Ethics School and provide proof that he has passed a professional responsibility exam given by the National Conference of Bar Examiners.
Evans stipulated to the probation conditions. No trial was held in the State Bar Court.
Evans was sentenced to four days in jail for his first offense and 12 days for his second. All the days were served working for California Rural Legal Assistance in Marysville under a work program offered by the Sutter County Sheriff’s Department.
His driver’s license was suspended after the second conviction.
